NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’ S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated November 24, 2006, executed by Borrowers, Michael J. O’ Connor and Carmelia L. O’ Connor, to Paul Hutchinson, the Trustee of record in the office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1519, at Page 208. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 25 Haskell Ln, Morgantown, WV 26508. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 12, 2016, of record in the Clerk’ s Office in Book 2132, at Page 678. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:
October 18, 2016 at 8:04 a.m.
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Union District, Monongalia County, West Virginia, and being more particularly described as follows:
All of the following described parcel of real estate together with the improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Union District, Monongalia County, West Virginia, and more particularly described as follows:
Beginning at a one-half inch reinforcing rod (set) located in the northwestern corner of the subject real estate, thence running with the common boundary line of lands belonging to John A. & Glenna D. Karolcik, North 50° 49’ 20" East 208.67 feet to a one-half inch reinforcing rod located in the western boundary line of lands now or formerly belonging to Edwin & Belinda Mathews; thence running with said Mathews’ lands, South 38° 15′ 00" East 180.46 feet to a one-half inch reinforcing rod (set); thence running with a new division line South 52° 21′ 20" West 182.53 feet to a one-half inch reinforcing rod (set), said point also being in the eastern boundary line of lands now or formerly belonging to Vincent Putkowski, thence running with lands of Vincent Putkowski, North 41° 00′ 00" West 126.24 feet to a one-half inch reinforcing rod; thence continuing with lands now or formerly belonging to Thomas & Karen Gurick, North 60° 30′ 00" West 53 feet to the point and place of beginning.
There is further granted an easement for a sewage treatment system and discharge pipe as is set forth on the attached plat. Said treatment plant is further described as being in the Northwestern corner of lands contiguous to the subject real estate.
There is reserved from this conveyance a ten foot easement for gas and water and maintenance of same running along the eastern right of way line of the subject real estate to be used by the Grantors, their successors, heirs and assigns.
There is further reserved a ten foot easement running along the western boundary line of the subject real estate for a sewage discharge pipe and maintenance of the same running from the northwestern corner of the subject parcel to the southwestern corner to be used by John and Glenna Karolcik, their successors, heirs, and assigns.
There is further reserved and non-exclusive easement sixteen feet in width for ingress, egress and regress, along the eastern boundary line of the subject parcel.
There is further conveyed a non-exclusive easement for ingress, egress and regress, sixteen feet in width, from the subject parcel to the public road. In accepting this easement the grantees, their successors, heirs and/or assigns covenant and agree to share in the maintenance of same on a pro-rats, basis
Being the same property which Michael J. O’Connor and Carmelia L. O’Connor, husband and wife, jointly and equally, with the Right of Survivorship acquired by Deed from Stephen R. Marcus and Robinlee Marcus recorded August 2, 2000 in Book 1202, Page 66 in the Monongalia County, West Virginia records.
TERMS OF SALE:
1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
