NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated February 18, 2008, from James F. Cook and Holly L. Cook to E. Dennis White, Trustee, of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia on Roll No. 5030, at page 4951, securing a promissory note in the principal amount of $90,129.97, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Raleigh County Courthouse in Beckley, West Virginia on October 17, 2016 at 9:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, a tract of land, together with the improvements thereon and appurtenances thereunto belonging, located on the southeast side of County Route 3-13, being 1200 feet northeast of State Route 3 near Stover in Trap Hill District, Raleigh County, West Virginia. The tract is more particularly bounded and described as follows: (Bearings are magnetic and distances are horizontal) Beginning at a rebar set on the southeast right of way of county Route 3/13 being 15 feet from center and new corner to McGraw and Tract 4, thence with new division lines and following the south right of way of County Route 3/13 for three calls; N 58 f 03′ 03″ E 72.93 feet; thence; N 53 f 15′ 33″ E 80.05 feet, thence; N 46 f 25′ 58″ E 108.23 feet to a rebar set on said right-of-way in line of Mozelle McCloud deed book 516-57 and in the extension of an old fence, thence leaving said right of way and with McCloud (found an old fence as evidence of line); S 22 f 53′ 48″ E crossing a run and continuing in all 248.85 feet to a 28″ black oak found in a fence intersection at the west base of a ridge line, said black oak being a common corner with McCloud and Tolliver, thence following the line with Tolliver S 62 f 36′ 58″ W crossing a run and continuing in all 228.20 feet to a rebar found, thence; N 29 f 40′ 19″ W passing a rebar found on line at 50.03 feet (corner to Tract 4) and continuing in all 199.27 feet to the Point of Beginning containing 1.20 acres more or less as surveyed in December, 2000 by Alpha Engineering Services, Inc. of Beckley, West Virginia, and verified monument locations in February and April, 2007 as shown on a plat made a part of this description. Being the same property conveyed from James E. McGraw and Christine McGraw, his wife, to James F. Cook and Holly L. Cook, husband and wife, by Deed dated February 15, 2008, of record in the aforesaid Clerk’s office on Roll No. 5030, at page 4950. Terms of the sale: cash on date of sale.
