NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated June 6, 2013, executed by Borrower(s), Stephan Frantz, to Douglas McElwee, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1770, at Page 320. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4017 Cypress St, Parkersburg, WV 26104. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 26, 2016, of record in the Clerk’s Office in Book 1917, Page 402. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:
June 30th, 2016 at 5:38 P.M.
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Parkersburg District, Wood County, West Virginia, and being more particularly described as follows:
That parcel of land situate in the City of Parkersburg, Wood County, West Virginia, and which is more particularly bounded and described as follows:
BEGINNING at an iron pipe (found) in the right of way line of Cypress Street and being the northeasterly most corner of Lot 25 of H. C. Brownás Redivision of Lots No. 66 to 72, inclusive, of Camden Farms Addition No. 2, a plat of which redivision is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 11, at page 51; thence with the northerly most line of said Lot 15. N. 73 degrees 55á W. 206 feet to an iron pipe (found); thence S. 14 degrees 58á W. 60 feet to an iron pipe (set); thence S. 70 degrees 23ã E. 163 feet (found) in the right of way line of Cypress Street N. 16 degrees 05á E. 20 feet to the place of beginning, being part of Lot No. 25 of said Redivision as more particularly shown on that certain plat prepared by Chet Waterman, P. E. and of record in the aforesaid Clerkás Office in Deed Book 741, at page 429.
Title to the above described property conveyed to Stephan Frantz from Stephanie J. Deem and Scott L. Deem by Deed dated and recorded May 27, 2003 in Book 1053 Page 573 or Instrument No. 408406.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
