NOTICE OF SALE OF VALUABLE REAL ESTATE BY SPECIAL COMMISSIONERS
Pursuant to an Order of the Circuit Court of Greenbrier County, West Virginia, made and entered on the 5th day of October, 2016, in the case of Wilma Shirley Bird Carruthers. v. Mary Rhodes Allen, Civil Action Number 16-C-19(B), the undersigned Special Commissioners will be on Wednesday the 2nd day of November, 2016, at the front door of the Courthouse of Greenbrier County, West Virginia, at 11:00 AM of that day offer for sale to the highest bidder the following described tract or parcel of real estate located in the Blue Sulphur District of Greenbrier County, West Virginia and being described by old description as follows:
“Tract of land, lyeinq (sic) on Bennett Mountain, Blue Sulphur Dis’t, Greenbrier County, West Virginia, beginning, at two beech trees and cornerto Hamilton Fleshman and E.Y. Rhodes and with the “latter East, 100 poles to a white oak where and (sic) old fence stood, thence, southward with the old fence to a stake by the side of a road, thence eastward with the road to Fleshmans’ line (90 poles) and with same to the place of the beginning, and containing fourty acres more or less asa boundary.” Tax Map 21, Parcel 107
TERMS:
1. THE SALE IS SUBJECT TO CONFIRMATION BY THE COURT.
2. Cash payment at time of sale or an irrevocable letter of crerdit addressed to the Special Commissioners guaranteeing payment of the purchase price.
3. The 2016 taxes and all subsequent taxes shall be the purchaser’s obligation.
4. Sale will be subject to continuance for good cause by orsal declaration of commissioners at time of sale.
5. Property issold “AS IS-WHERE IS” AS TO MATTERS OF SURVEY. SALE IS IN GROSS AND NOT BY THE ACRE.
6. Buyer is responsible to pay for any title examination which must be conducted prior to sale. Buyer will pay transfer stamps and recording fees.
