NOTICE OF SALE UNDER DEED OF TRUST Under authority of a certain Deed of Trust from Cambridge Stone, LLC, dated the 19th day of May, 2009 and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5035, at page 6363; default having been made in the payment of the obligations secured by said Deed of Trust and sale having been requested by the beneficial owner, the undersigned will offer for sale at the front door of the Courthouse of Raleigh County, Beckley, West Virginia, on Tuesday, November 1, 2016 at 9:30 o’clock a.m., that certain real estate conveyed by said Deed of Trust as described on Exhibit “A” attached hereto and made a part hereof. EXHIBIT A – CAMBRIDGE STONE, D/B/A REVIERA STONE The following described lots or parcels of land located in Town District, Raleigh County, West Virginia, and more particularly bounded and described as follows: FIRST TRACT: Lots Nos. 16, 17, 18, 19, 20, 21, 22 and 23 of the Ralph Woods Addition No. 2, in Town District, Raleigh County, West Virginia, as shown upon a map of said addition filed in the office of the Clerk of the County Court of said Raleigh County in Map Book 8, at page 191. SECOND TRACT: The surface of those two certain lots or parcels of land, together with all the appurtenances thereunto belonging, situate in Town District, Raleigh County, West Virginia, and being Lots Nos 24 and 25 of the Ralph Woods Addition No. 2, as shown on a map thereof recorded in the office of the Clerk of the County Court of Raleigh County in Map Book No. 8, at page 191, each of which said lots fronts 50 feet on Hank Woods Drive and extends back between parallel lines a distance of 122.5 feet. THIRD TRACT: Lot No. 26 of the Ralph Woods Addition No. 2, in Town District, Raleigh County, West Virginia, as shown upon a map of said addition filed in the office of the Clerk of the County Court of said Raleigh County in Map Book 8, at page 191. And being the same property heretofore acquired by Cambridge Stone, LLC d/b/a Riviera Stone by Deed dated the 1st day of March, 2004, from Pine Grove Realty Company, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5012, at page 6190. TERMS OF SALE 1. The property will be sold and conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, including any liens for sewer service assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances, and conditions of record in the Clerk’s office or affecting the subject property. 2. The Beneficiary and/or the Servicer of this Deed of Trust and Note reserve the right to submit a bid for the property as sale. 3. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 4. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDING TO LAW. 5. The total purchase price is payable to the Trustee by cashier’s check, cash, or the equivalent on day of sale. 6. FEDERAL TAX LIENS: IF THERE ARE FEDERAL TAX LIENS AGAINST THE SUBJECT PROPERTY AND AS A RESULT THE UNITED STATES WOULD HAVE THE RIGHT TO REDEEM THE PROPERTY WITHIN A PERIOD OF 120 DAYS FROM THE DATE OF THE SALE OR ANY OTHER PERIOD ALLOWABLE FOR REDEMPTION UNDER LOCAL LAW, WHICHEVER IS LONGER. 7. THE UNDERSIGNED RESERVES THE RIGHT TO CONTINUE THE SALE, OR TO ADJOURN THE SALE, FOR A TIME, OR FROM TIME TO TIME, WITHOUT FURTHER NOTICE THAN ANNOUNCEMENT OF THE TIME AND PLACE OF SALE AS HEREIN ABOVE SET FORTH FOR ANY CONTINUANCE OR ADJOURNMENT THEREOF.
