NOTICE OF TRUSTEE’S SALE
Take notice that on the 1* day of September, 2016, at 10-00 a.m., at the front entrance of the Marion County Courthouse, Fairmont, West Virginia, the undersigned Substitute Trustee will sell at public auction to the highest bidder the real estate hereinafter described pursuant to that certain deed of trust dated April 21, 2005, executed by Victoria Gregory to Michael L. Solomon, Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book No. 832, at page 369, default having been made therein, that certain lot or parcel of real estate situate on U. S. Route No. 250, in Grant District, Marion County, West Virginia, which was resurveyed by McCoy Surveying Company, Inc., and shown on a plat of record in said Clerk’s office in Deed Book No. 929, at page 341, described as follows:
Beginning at a point on the northern right of way limits of U. S. Route 250; thence following U. S. Route 250 for five lines, N. 70° 421 W. 42.27 feet to a point; thence N. 45° 51’ W. 40.78 feet to a point; thence N. 38° 11’ W. 40.92 feet to a point; thence N. 26° 26’ W. 46.78 feet to a point; thence N. 19° 11′ W. 74.45 feet to a point on the right of way limits of U. S. Route 250, corner to James Robinson; thence with a line of Robinson, S. 80* 00’ E. 242.27 feet to a 11/2″ pipe found, corner to Thomas Dougal; thence with two lines of Dougal, S. 28° 06’ 40″ W. 70.44 feet to a 3/4″ pipe found; thence S. 38* 30‘ W. 105.47 feet to the place of beginning, containing 0.569 acres.
The above real estate was conveyed to Victoria Gregory by Federal Home Loan Mortgage Corporation etc., by deed dated September 20,2004, of record in said Clerk’s office in Deed Book No. 1002, at page 700.
Conveyance of said real estate is subject to the exceptions, reservations, restrictions, rights of way, and conditions, of record, affecting said real estate, and is subject to all unpaid property taxes assessed against said real estate.
The property will be conveyed in an “as is” physical condition, without warranty as to habitability or fitness.
The trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the trustee.
By written substitution of trustee dated August 8, 2016, of record in said Clerk’s Off ice, J. Scott Tharp was substituted as substitute trustee under the provisionsof said deed of trust.
The total purchase price is payable to the trustee by cashier’s check, cash, or the equivalent within 20 days of the date of sale, with 10% of the total purchase price payable to the trustee at sale by cashier’s check, cash, or the equivalent.
